Use of the GameIS.com site (the “Site”) signifies your acceptance of these terms of use. This is a legal agreement between you and NEOACT. You represent that you have the capacity to make this agreement.

1. Eligibility.
The Site and services (collectively, the “Service”) are for users age 13 and over. If you are over the age of 13, but still considered a minor, we ask that you review these terms with your parents or guardian to ensure they understand them and agree to them.

2. Ownership.
All rights and title in and to the Site and the Service (including without limitation any user accounts, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, "applets" incorporated into the software, trans c r i p ts of the chat rooms, character profile information, recordings of games, and the program client and server software are owned by NEOACT or its licensors.

3. Establishing a User Identity.
A. When creating a user identity (“User ID”), you must provide truthful and accurate information. . Your failure to supply accurate information to NEOACT when requested, or to update that information as it changes, shall constitute a material breach of this Agreement. .

B. You, as creator of your User ID, are completely responsible for your identity. NEOACT will not tolerate offensive or obscene user identities. If a User ID violates any part of these terms, we may immediately, temporarily or permanently ban such User ID.

C. During the registration process, you will be required to select a user name and a password that are specific to your account (collectively referred to hereunder as "Password"). Your Password is to be kept confidential at all times and you are solely responsible for the security of your Password and your account. You may not disclose your Password to anyone, or allow your Password to be used by any one beside yourself to play at GameIS. Any damage or harm that may result to your account, or to GameIS, due to lost or deleted characters or lost or deleted items within the account due to your disclosure of your Password, or due to the discovery of your Password by a third party, is your sole responsibility.

4. Password/User ID Security
You are responsible for maintaining the confidentiality of your User ID and Password, and you will be responsible for all uses of your User ID and Password, whether or not authorized by you. Also, note that the security of your account is your responsibility. NEOACT is not responsible in the event that your account is "hacked," or if your account or computer is damaged by a virus, or for any other issues with your computer or your account which may occur in conjunction with your use of GameIS.
In the event that you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of your Login Information, you must immediately notify NEOACT by Q&A Board.


5. Limitations on Your Use of the Service.
A. Only NEOACT or its licensees have the right to host the GameIS games (the “Games”). You may not host or provide matchmaking services for the Games, or intercept, emulate or redirect the proprietary communication protocols used by NEOACT in connection with the site related programs (the “Program”), regardless of the method used to do so. Such prohibited methods may include, but are not limited to, protocol emulation, reverse engineering, modifying the Program, adding unauthorized components to the Program, or using a packet sniffer while the Program is running.

B. You agree that you will not (i) modify or cause to be modified any files that are a part of the Program or the Service (ii) create or use cheats, bots, "mods", and/or hacks, or any other third-party software designed to modify the Program experience or (iii) use any third-party software that intercepts, "mines", or otherwise collects information from or through the Program or the Service.

C. You may not disrupt or assist in the disruption of (i) any computer used to support the Service (each a "Server") or (ii) any other player's Games experience. ANY ATTEMPT BY YOU TO DISRUPT THE SERVICE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. You agree that you will not violate any applicable law or regulation in connection with your use of the Program or the Service.
D. NEOACT reserves the exclusive right to create derivative works based on the Program. You may not create derivative works based on the Program without NEOACT's prior written consent.

6. Rules of Conduct.
A. You must observe these terms, all applicable laws and also basic rules of etiquette and common courtesy when using the Site. Any conduct that violates the law in an offline, real world community is also a violation of these terms. NEOACT will not tolerate any illegal conduct.

Conduct that violates these terms includes, but is not limited to:

Embarrassing, harassing, or threatening another user or users, directly or indirectly.
Posting pictures of, or posting links to, pornographic material.
Using obscene language.
Posting any libelous or defamatory material.
Publishing any presentation that infringes the copyrights, trademarks or other intellectual property rights of any person.
Flooding, spamming, or disrupting chat areas.
Running any scam or any commercial business through the Site.
Impersonating someone, whether for fun or for ill gain.
Attempting to hack or exploit any bug or glitch to obtain an unfair advantage.
Any other activity that prohibits other users from enjoying the services provided on the Site.

B. NEOACT may take any actions and impose any penalties we deem necessary to discourage and punish any violation of these terms or any other illegal or inappropriate conduct, all without prior notice or warning. The determinations as to whether a violation has occurred and who is responsible for such act are solely within NEOACT's discretion, and are based on what we deem best for the community. By using the Site, you agree you will be bound by NEOACT's determination as to whether a violation has occurred and any penalty we choose to implement.

7. NEOACT's Absolute Right to Suspend, Terminate and/or Delete the Account.
NEOACT MAY SUSPEND, TERMINATE, MODIFY, OR DELETE THE ACCOUNT AT ANY TIME WITH ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE. For purposes of explanation and not limitation, most account suspensions, terminations and/or deletions are the result of violations of this Terms of Use.

8. Ownership/Selling of the Account or Virtual Items.
NEOACT does not recognize the transfer of Accounts. You may not purchase, sell, gift or trade any Account, or offer to purchase, sell, gift or trade any Account, and any such attempt shall be null and void. NEOACT owns, has licensed, or otherwise has rights to all of the content that appears in the Program. You agree that you have no right or title in or to any such content, including the virtual goods or currency appearing or originating in the Games, or any other attributes associated with the account or stored on the Service. NEOACT does not recognize any virtual property transfers executed outside of the Games or the purported sale, gift or trade in the "real world" of anything related to the Games. Accordingly, you may not sell items for "real" money or otherwise exchange items for value outside of the Games.

9. Changes to the Terms of Use Agreement or the Program.
NEOACT reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement at any time, including without limitation access policies, the availability of any feature of the Program, hours of availability, content, data, software or equipment needed to access the Program, effective with or without prior notice provided, however, that material changes (as determined in NEOACT's sole and absolute discretion) will be disclosed as follows: NEOACT will provide you with notification of any such changes to the Program through a patch process, website posting, pop-up screen, or in-game notice. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must terminate, and immediately stop using, the Program and the account. Your continued use of the Program following any revision to this Agreement constitute your complete and irrevocable acceptance of any and all such changes. NEOACT may change, modify, suspend, or discontinue any aspect of the Program at any time. NEOACT may also impose limits on certain features or restrict your access to parts or all of the Program without notice or liability.

10. Termination
This Agreement is effective until terminated by either party. Users can terminate their own accounts. The termination procedures are written in the GameIS “termination” page. After a request for termination, NEOACT permanently deletes all the information concerned with your account so it will be impossible to retrieve your lost data.

11. Inactive Game IDs
Your User ID will be de-activated if you do not use it for any continuous period of three months after last usage. If you do not use your User ID for three or more months, it may be removed and deleted by the GameIS Administrator in its sole discretion.

12. Game Money
Certain areas of the Service contain functions for purchasing items using in-game fictional game money. The game money is called "Cash”. Game money is not redeemable for real currency once you have paid for it. NO REFUND IS AVAILABLE. Use of game money for any purposes other than as authorized on the Site, whether online or offline is a violation of these terms. You agree that NEOACT has the absolute right to manage, regulate, control, modify and/or eliminate such game money as it sees fit in its sole discretion, and that NEOACT will have no liability to you based on its exercise of such right. Purchasing Cash with illegal means(which will be a violation of criminal and civil laws) will cause your accounts to be terminated without any notice.

13. Warranty Disclaimer
THE GAMES ARE PROVIDED "AS ARE" AND NEOACT DOES NOT WARRANT THAT THE GAMES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAMES OR THE SERVICE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NEOACT EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR USE, AND NON-INFRINGEMENT.

14. Submissions and User IDs
"Submissions" means all comments, feedback, suggestions, photos, postings at forums, chat rooms and similar venues on the Site, e-mails and similar information or materials that you submit to NEOACT regarding the games and services of NEOACT or the use or play of those games and services. User IDs and Submissions are not confidential and will become the property of NEOACT upon submission. You agree to assign to NEOACT, at no charge, all worldwide rights, title and interest in copyrights and other intellectual property rights to the User IDs and Submissions. You acknowledge that you are responsible for the Submissions that you provide and for managing your User ID. You, and not NEOACT, have full responsibility for your Submissions and User ID, including their legality, reliability, appropriateness, originality and copyright. As a matter of policy, NEOACT does not prescreen or monitor any Submissions.

All materials published in forums, chat rooms and similar venues on the Site are considered public. Therefore, NEOACT strongly recommends that you do not publish any personal information about yourself or others on or through the Site.

15. Third Party Sites
Clicking a hyperlink may direct you away from the Site. NEOACT does not endorse or control any third party linked sites, is not responsible for their content and has no association with the owners or operators of such sites. Also, other sites may have different terms of service and different privacy policies. NEOACT therefore strongly recommends that you inform yourself regarding the practices of third party websites.

16. Limitation of Liability
NEITHER NEOACT NOR ITS PARENT, SUBSIDIARIES, LICENSORS OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR DAMAGE OR LOSS OF ANY KIND RESULTING FROM (A) THE USE OF OR INABILITY TO USE THE PROGRAM OR SERVICE INCLUDING WITHOUT LIMITATION LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION (B) THE LOSS OR DAMAGE TO PLAYER CHARACTERS, ACCOUNTS, STATISTICS, INVENTORIES, USER PROFILE INFORMATION STORED BY THE SERVICE OR (C) INTERRUPTIONS OF SERVICE INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL NEOACT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES.

17. Force Majeure
NEOACT shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of NEOACT, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond NEOACT's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.

18. Acknowledgments.
You hereby acknowledge and agree that:

A. WHEN RUNNING, THE PROGRAM MAY MONITOR YOUR COMPUTER'S RANDOM ACCESS MEMORY (RAM) AND/OR CPU PROCESSES FOR UNAUTHORIZED THIRD PARTY PROGRAMS. AN "UNAUTHORIZED THIRD PARTY PROGRAM" AS USED HEREIN SHALL BE DEFINED AS ANY THIRD PARTY SOFTWARE, INCLUDING WITHOUT LIMITATION ANY "ADDON" OR "MOD," THAT IN NEOACT'S SOLE DETERMINATION: (i) ENABLES OR FACILITATES CHEATING OF ANY TYPE (ii) ALLOWS USERS TO MODIFY OR HACK THE SERVICE, ENVIRONMENT, AND/OR EXPERIENCE IN ANY WAY NOT EXPRESSLY AUTHORIZED BY NEOACT OR (iii) INTERCEPTS, "MINES," OR OTHERWISE COLLECTS INFORMATION FROM OR THROUGH THE PROGRAM. IN THE EVENT THAT THE PROGRAM DETECTS AN UNAUTHORIZED THIRD PARTY PROGRAM, NEOACT MAY (a) COMMUNICATE INFORMATION BACK TO NEOACT, INCLUDING WITHOUT LIMITATION YOUR ACCOUNT NAME, DETAILS ABOUT THE UNAUTHORIZED THIRD PARTY PROGRAM DETECTED, AND THE TIME AND DATE THE UNAUTHORIZED THIRD PARTY PROGRAM WAS DETECTED AND/OR (b) EXERCISE ANY OR ALL OF ITS RIGHTS UNDER SECTION 4 OF THIS AGREEMENT, WITH OR WITHOUT PRIOR NOTICE TO THE USER.

B. NEOACT MAY OBTAIN CERTAIN IDENTIFICATION INFORMATION ABOUT YOUR COMPUTER AND ITS OPERATING SYSTEM, INCLUDING WITHOUT LIMITATION YOUR HARD DRIVES, CENTRAL PROCESSING UNIT, IP ADDRESS(ES) AND OPERATING SYSTEM(S), FOR PURPOSES OF IMPROVING THE PROGRAM AND/OR THE SERVICE, AND TO POLICE AND ENFORCE THE PROVISIONS OF THIS AGREEMENT.

C. NEOACT may, with or without notice to you, disclose your Internet Protocol (IP) address(es), personal information, and information about you and your activities in response to a written request by law enforcement, a court order or other legal process. NEOACT may use or disclose your personal information if NEOACT believes that doing so may protect your safety or the safety of others.

D. NEOACT MAY RECORD YOUR CHAT SESSIONS AND OTHER ELECTRONIC COMMUNICATION TRANSMITTED OR RECEIVED THROUGH THE GAME AND YOU CONSENT TO SUCH MONITORING OR LOGGING.

E. You are wholly responsible for the cost of all telephone and Internet access charges along with all necessary equipment, servicing, repair or correction incurred in maintaining connectivity to the Servers.

19. Equitable Remedies.
In the event that you breach this Agreement, you hereby agree that NEOACT would be irreparably damaged if this Agreement were not specifically enforced, and therefore you agree that NEOACT shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of this Agreement, in addition to such other remedies as NEOACT may otherwise have available to it under applicable laws. In the event any litigation is brought by either party in connection with this Agreement, the prevailing party in such litigation shall be entitled to recover from the other party all the costs, attorneys' fees and other expenses incurred by such prevailing party in the litigation.

20. Governing Law
If any disputes should arise under this Agreement, which you and NEOACT are unable to resolve in any other way, then it is agreed that it will be governed by and interpreted in accordance with the laws of South Korea and will be resolved in the South Korean courts. You hereby expressly submit to the jurisdiction of the South Korean Courts in respect of any and all disputes arising under this agreement.

21. Miscellaneous.
If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This Terms of Use Agreement is the complete and exclusive statement of the agreement between you and NEOACT concerning the Service, and this Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications with regard thereto between you and NEOACT. This Agreement may only be modified as set forth herein. The section headings used herein are for reference only and shall not be read to have any legal effect.

I HEREBY ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING TERMS OF USE AGREEMENT AND AGREE THAT MY USE OF THE PROGRAM AND/OR THE SERVICE IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS TERMS OF USE AGREEMENT.
